1. Acceptance of Terms
Welcome to Gens Catholica (“Platform,” “we,” “us,” or “our”), operated by Gens Catholica LLC, a New Jersey limited liability company.
By accessing or using the Platform, creating an account, subscribing, purchasing content, participating in chats or livestreams, or otherwise using our services, you agree to these Terms of Service (“Terms”). If you do not agree, you must not use the Platform.
2. Platform Description
Gens Catholica is a subscription-based platform connecting users with Catholic creators offering faith-aligned content, discussion, education, and community. Features may include monthly subscriptions, one-time video unlocks, livestreams, private chats, paid discussions, articles, and related tools.
We may modify, suspend, or discontinue any feature or offering at any time.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction). By using the Platform, you represent that you can enter binding contracts, your use complies with all laws, and all information you provide is accurate and complete.
We reserve the right to refuse service where use would be unlawful or inconsistent with our mission.
4. User Accounts
You are solely responsible for keeping your account credentials secure and for all activity under your account. Account sharing, impersonation, or unauthorized access is prohibited. We may suspend or terminate accounts at our discretion.
5. Subscriptions, Payments & Billing
Purchases are processed through third-party providers such as Stripe. By purchasing, you authorize us to charge your payment method for recurring or one-time fees.
Subscriptions automatically renew unless canceled before the renewal date. Cancellation stops future charges but does not provide refunds for the current period.
All subscription fees, PPV unlocks, paid sessions, and digital purchases are generally non-refundable once the billing period begins or access is granted. If your account is suspended or terminated for violation of these Terms, community standards, or misconduct, you will not receive a refund for any remaining portion of your subscription. We may, in our reasonable discretion, issue refunds for technical errors, duplicate charges, or other good-faith situations. Fraudulent chargebacks or refund abuse may result in immediate termination.
5.1 Gift Subscriptions
The Platform offers the ability to purchase gift subscriptions for other users.
Gift subscriptions are prepaid purchases made on behalf of a recipient and are **non-refundable** once the subscription is activated or redeemed by the recipient.
The purchaser (giver) is solely responsible for providing accurate recipient information (including email address). The Platform is not responsible for gifts sent to incorrect or invalid email addresses.
If the recipient does not have an account, one will be automatically created using the provided email. Recipients may need to set a password or verify their email to activate the gift.
Gift subscriptions are subject to these Terms of Service. Unless otherwise stated at the time of purchase, gifted subscriptions **do not automatically renew** after the gifted period ends.
6. User-Generated Content
You are responsible for all content you post, comment, message, or share. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and moderate that content as needed to operate the Platform. You warrant that your content complies with these Terms and does not infringe third-party rights.
7. Prohibited Content and Conduct
Gens Catholica is a mission-driven platform dedicated to Catholic evangelization and Christian community rooted in reverence, respect, moral seriousness, and charity. We are not a neutral public forum.
You may not post, share, or engage in:
- Illegal content or activities
- Pornography, explicit sexual content, sexually suggestive imagery, “thirst trap” content, or anything creating the appearance of impropriety
- Harassment, threats, abuse, doxxing, or intimidation
- Exploitation of minors
- Copyright infringement
- Spam, fraud, malware, or scams
- Conduct that materially conflicts with Catholic moral teaching or the Platform’s mission
We retain sole discretion to determine what violates these standards.
8. Community Features & User Responsibility
Creators are independent parties and not our employees or agents. You are solely responsible for your interactions with creators and other users. We do not supervise, endorse, or guarantee any creator’s conduct, advice, availability, or opinions.
9. Spiritual Guidance & Educational Content
The Platform does not provide medical, psychological, legal, or licensed counseling services. Any spiritual guidance or advice is offered solely by independent creators. Users assume full responsibility for decisions made based on Platform content and should seek qualified professionals for serious needs.
10. Moderation and Termination
We maintain broad discretion to enforce our mission and standards. We may remove content, restrict features, or terminate accounts immediately for violations, mission conflicts, reputational risk, fraud, or other concerns. These decisions are final.
11. Livestreaming, Media & Availability
All livestreams, media, and interactive features are provided “as available.” We do not guarantee uninterrupted service, permanent archiving, or error-free performance.
12. Recordings & Communications
Live sessions and communications may be monitored or recorded for safety and enforcement purposes. By participating, you consent to such monitoring where permitted by law. You may not record, redistribute, or share paid or private content without authorization.
13. Intellectual Property
All Platform branding, design, software, and non-user content belong exclusively to Gens Catholica LLC. Unauthorized downloading, scraping, redistribution, or archival of paid content is strictly prohibited. You may not copy, scrape, reverse engineer, resell access, or create derivative services.
14. Copyright Complaints (DMCA)
We respect intellectual property and respond to valid DMCA notices. Repeat infringers may be terminated.
15. Data Privacy
The Platform is operated from the United States. It is not directed to users in the European Union or European Economic Area, and we do not hold ourselves out as doing business in, or offering goods or services to data subjects in, the EU/EEA.
Your information may be processed and stored in the United States. Please review our Privacy Policy for details. By using the Platform, you consent to our data practices.
16. Disclaimers
The Platform is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, Gens Catholica LLC disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not endorse, verify, or guarantee the accuracy, orthodoxy, or quality of any creator content, advice, or interactions.
17. Limitation of Liability
To the fullest extent permitted by law, Gens Catholica LLC shall not be liable for any indirect, consequential, punitive, or incidental damages. In no event shall our total liability exceed the total amount you paid to us in the twelve (12) months preceding a claim.
18. Indemnification
You agree to indemnify, defend, and hold harmless Gens Catholica LLC and its affiliates from claims arising from your use of the Platform, your content, your conduct, or your violation of these Terms.
19. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance.
20. Termination
We may suspend or terminate your access at any time. Certain provisions survive termination.
21. Force Majeure
We are not liable for delays or failures to perform caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, internet or infrastructure failures, cyberattacks, or failures of third-party providers.
22. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
23. Governing Law & Dispute Resolution
These Terms are governed by New Jersey law. Disputes shall be resolved exclusively through binding arbitration in New Jersey under American Arbitration Association rules. You waive jury trials and class actions.
24. Entire Agreement
These Terms constitute the entire agreement between you and Gens Catholica LLC.
